Terms & Conditions
The basis on which ComboFever accepts and delivers event bookings in New Zealand.
1. These terms
These Terms and Conditions govern the supply of services by ComboFever (“we”, “us”), to the person or organisation booking an event (“the Client”). They apply together with the written proposal and quotation issued for a specific event, which prevails where there is any inconsistency.
2. The service
We provide offline, in-person event entertainment: casino-themed tables, trained hosts, symbolic chips and cards, event production and related branding, delivered at a venue nominated by the Client in New Zealand.
For the avoidance of doubt, and as a fundamental term of every booking:
- the service is not gambling and is not offered as a gambling activity;
- no bets, stakes or wagers of any kind are placed at our tables;
- chips and points are symbolic props with no monetary value. They are issued free of charge, cannot be purchased, and cannot be exchanged for money, vouchers, goods or any other benefit;
- no cash prizes or cash-equivalent prizes are awarded. Any end-of-event recognition is limited to non-monetary keepsakes such as trophies, certificates or branded items;
- we provide no online casino service, application, platform or play-for-money website of any kind;
- events are strictly for adults aged 20+ and over.
3. Bookings
- An enquiry is not a booking. We issue a written proposal and quotation for the specific event.
- A booking is confirmed when the Client accepts the quotation in writing and any advance payment stated in it has been received.
- We may decline or withdraw from a booking where the event would breach these terms, in particular the age policy or the no-gambling rule.
- The Client must give accurate information about the venue, access, guest numbers and timings. Changes that materially affect the quotation may require a revised proposal.
4. Prices and payment
We do not publish prices. Every event is quoted individually on the basis of its size, venue, chosen formats, staffing and travel. The quotation states the fee, any advance payment, the payment schedule and what is included.
Unless the quotation says otherwise: an advance payment is payable to secure the date, the balance is payable in accordance with the schedule in the quotation, and all amounts are stated exclusive of GST where GST applies. Late payment may attract interest at the rate stated in the quotation.
5. Cancellation and postponement
- Cancellation by the Client must be notified in writing. The cancellation charges set out in the quotation apply and reflect crew, equipment and production commitments already made.
- Where a date is postponed and we have equivalent availability, we will use reasonable endeavours to transfer the booking rather than apply a cancellation charge.
- If we cancel for any reason other than the Client's breach or an event of force majeure, we refund all sums paid for the cancelled booking.
6. The Client's responsibilities
- Ensuring that every guest with access to the entertainment area is aged 20+ or over.
- Obtaining the venue's permission for our equipment, access times and any lighting we supply, and passing on the technical sheet we provide.
- Providing safe, level and sufficient space, reasonable access for loading, and standard power where the quotation requires it.
- Supervising guest behaviour. Our hosts may suspend a table where behaviour becomes unsafe or where the adults-only policy cannot be respected.
- Ensuring that no guest is encouraged to treat the entertainment as gambling, and that no money changes hands at or around our tables.
7. Our responsibilities
- Supplying the equipment, staffing and services described in the accepted quotation.
- Attending at the agreed times and leaving the venue in the condition we found it.
- Briefing every host to state clearly, before a table opens, that the chips are symbolic and that nothing is played for money.
- Holding the insurance stated in the quotation.
8. Equipment and damage
All equipment remains our property at all times, including in dry hire bookings. The Client is responsible for loss of or damage to equipment caused by guests or by the venue during the hire period, fair wear and tear excepted. Dry hire is subject to a written briefing confirming that the tables may only be used for adults-only entertainment with symbolic chips.
9. Photography and references
We do not publish client names or logos without written permission. Where we wish to use event photography, we ask the Client in advance and only use images where identifiable guests have agreed.
10. Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot lawfully be limited, including rights the Client may have under the Consumer Guarantees Act 1993 where it applies.
Subject to that, our total liability arising out of or in connection with a booking is limited to the total fee paid for that booking, and we are not liable for indirect or consequential loss, loss of profit, loss of business or loss of anticipated savings.
11. Force majeure
Neither party is liable for failure to perform caused by events beyond its reasonable control, including natural events, severe weather, fire, flood, earthquake, epidemic, public health restrictions, strike action, failure of utilities or closure of the venue. Where such an event prevents an event from proceeding, we will offer an alternative date where we can, and otherwise refund sums paid less costs already irrecoverably incurred.
12. Complaints
Please raise any concern with your producer on the night if possible, and in writing to [email protected] within 14 days of the event. We acknowledge complaints promptly and aim to resolve them within 20 working days.
13. Governing law
These terms are governed by the laws of New Zealand, and the parties submit to the non-exclusive jurisdiction of the courts of New Zealand.
